Minutes of Meeting -- April 17, 2003
A meeting of the Hudson Conservation Commission was held in the
Hudson Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:00 p.m., Acting Chairman John Sturgis called the assembly to order.
Present were:     Minot Wood, David Esteves, William Brochu and John Sturgis
Absent was:     Martin Moran, Jose Rodrigues and Judith Sabourin        



4 Day's Circle     (RDA)



    Present was:     Kenneth McGowan

Mr. McGowan presented his plan to the Commission.  He would like to clean up the area and cut some dead trees.  He will also plant new trees.  He will be taking down at least five or six trees down.  The trees he plants will be probably pines and willows.

David Esteves, seconded by Minot Wood, made a motion to issue a negative determination for 4 Day’s Circle in accordance with the RDA dated January 13, 2003 with the conditions that no more than six dead standing trees be cut and that the Commission be notified when work begins.

Vote:   4-0-0 unanimous




1 Merritt Drive     (RDA)



    Present was:     Joe Dykers

Mr. Dykers presented the plan to the Commission.  He would like to construct a farmer’s porch and a one-car garage.  The porch will be on footings.  They will be done by hand.  The garage will be on a concrete slab there will be a four-foot excavation.  The Commission would like to see a line of hay bales behind the proposed garage.  

Minot Wood, seconded by Bill Brochu, made a motion to issue a negative determination for 11 Merritt Drive in accordance with the plot plan dated March 16, 1994 with the condition that before the foundation of the garage is dug, hay bales are placed and the Commission is called for an inspection.

Vote:   4-0-0 unanimous




24 Lee Circle     (NOI)



    Present was:     Tom DiPersio

Mr. DiPersio presented the plan to the Commission.  The applicant would like to construct an addition to the house and extend the driveway.  The project will be within 100 feet of the Assabet River.  The footprint of the work includes 1200 square feet of impervious surface.

Mr. DiPersio offered to propose a recharge area at the base of the driveway.  He also handed out an alternatives analysis.  Mr. Wood reminded the Commission that there are certain exceptions for single-family house lots more than 50 feet away.  

The Commission would like to see the driveway moved at least fifty feet away from the river.

Bill Brochu, seconded by David Esteves, made a motion to close the public hearing and issue an Order of Conditions for 24 Lee Circle in accordance with the plan entitled “Site Plan of Land in Hudson, MA” as drawn by Thomas Land Surveyors of Hudson, MA and dated March 18, 2003 with the condition that all work and pavement be moved at least fifty feet from the river and that the hay bales be in place and the Commission called before work begins.

Vote:   4-0-0 unanimous




Minutes



John Sturgis, seconded by Minot Wood, made a motion to approve the minutes of the April 3, 2003 meeting as written.
Vote:   4-0-0 unanimous




Falls Brook



Mr. Esteves expressed concern that Mr. Ansari will begin construction on the house on lot 17 before a remediation plan is in place.  He would the Commission to issue an enforcement order until a plan is filed with the Commission.  The other members agreed.

David Esteves, seconded by Bill Brochu, made a motion to issue an enforcement order to Farooq Ansari on Lot 17 Falls Brook prohibiting all work until a plan is approved by the Conservation Commission correcting the existing site problems.

Vote:   4-0-0 unanimous
